Terms of Use

Welcome to Fish Audio ("App", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the Fish Audio mobile application, services, tools, and AI voice cloning technology. By downloading, accessing, or using Fish Audio, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Eligibility & Accounts

You must be at least 13 years of age (or the legal age of majority in your jurisdiction) to use Fish Audio. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Service

Fish Audio provides artificial intelligence (AI) powered text-to-speech (TTS) synthesis, custom voice cloning, and audio processing services. Features may require credits, subscriptions, or in-app purchases processed through official app storefronts.

3. Voice Cloning & User Content Responsibilities

CRITICAL REQUIREMENT: You must have full authorization, legal rights, and explicit consent to record, upload, or clone any voice sample you submit to Fish Audio.

When uploading audio files or recording voice prompts for voice cloning or TTS generation:

• Consent & Authorization: You affirm that you own or have obtained all necessary licenses, permissions, rights, and consents from the voice owner to record and clone their voice.
• No Unauthorized Impersonation: You agree not to clone or impersonate public figures, celebrities, political figures, or private individuals without their express written authorization.
• Illegal & Harmful Content Prohibited: You agree not to use cloned voices to generate audio that is fraudulent, deceptive, defamatory, abusive, harassing, hateful, obscene, or infringing upon third-party rights.

4. Prohibited Uses

You agree not to engage in any of the following prohibited activities:

• Using the App for any illegal purpose or to violate local, state, national, or international laws.
• Generating synthetic audio designed to deceive, scam, blackmail, or mislead individuals (e.g., deepfake scams, impersonation fraud).
• Reverse engineering, decompiling, or attempting to extract the underlying source code or AI models of Fish Audio.
• Attempting to bypass credit limits, subscription paywalls, or rate limits.

5. Intellectual Property Rights

• App Materials: All software, design, logos, graphics, and underlying AI technology of Fish Audio are owned by us or our licensors and are protected by intellectual property laws.
• User Audio Outputs: Subject to your compliance with these Terms, you retain ownership of the generated audio outputs created through your authorized use of the App, provided that your input audio and prompts do not violate third-party rights.

6. In-App Purchases, Subscriptions & Refunds

• Billing & Renewals: Payments, subscriptions, and credit purchases are processed directly by the Apple App Store or Google Play Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period in your app store settings.
• Refund Policy: All purchases are managed under the store policies of the Apple App Store or Google Play Store. We do not process direct monetary refunds.

7. Limitation of Liability & Disclaimers

THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FISH AUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR GENERATED AUDIO CONTENT.

8. Termination

We reserve the right to suspend or terminate your access to Fish Audio immediately, without prior notice, if you breach any provision of these Terms or engage in illegal or unauthorized voice cloning practices.

9. Changes to Terms

We may modify these Terms at any time. Continued use of the App after any modifications indicates your acceptance of the updated Terms.
